Пояснения Сергея Жаткина по предъявляемым обвинениям:
Мне не понятно, почему Королёв и его команда единомышленников пишет о том, что в СНТ я «без году неделя…», в СНТ моя семья владеет участком 10 лет.
Я никогда не называл себя «юристом».
Мне не понятно, о каком рейдерском захвате идёт речь. Власть в нашем СНТ, согласно Устава СНТ принадлежит общему собранию членов СНТ. Правление же СНТ, это «слуга» СНТ, которое обязано исполнять решения общего собрания. Более того, на общем собрании членов СНТ 13.09.2020 г. мне многие предложили избираться в Председатели Правления СНТ, а я взял самоотвод. И каким боком здесь рейдерский захват?
То, что касается подсчёта голосов, то я высказал своё мнение и зачитал статью из закона ФЗ №217. Да, я не юрист, как некоторые, имею право ошибаться, не правильно понял написанное в статье. Меня поправили, я с замечанием согласился, спорить не стал. Считаю, это нормально. Диалог — это не преступление, и Королёв Иван как адвокат должен это знать. При этом он был на собрании и не понимаю, почему он сразу не обвинил меня публично?
Мне не понятно, о каких далеко идущих планах говорит эта группа лиц, во главе Королёва.
Эта группа лиц, во главе Королёва Ивана говорит об обнародованной нами цели — захвате зимнего водопровода и денежных средств. Это ложь. Такого заявления мы не делали. И интересно бы спросить у этой группы лиц, как вообще это возможно? Как можно захватить водопровод у СНТ и требовать деньги? Дело то подсудное…..
Королёв Иван сделал замечание о размещении информации об «Активе» на сайте нашего СНТ. Согласен, не правильно это, я тут же тогда моментально удалил данную информацию с сайта, пока он продолжал зачитывать своё заявление. Он также обвиняет меня в том, что я пытаюсь ввести всех в заблуждение, чтобы все считали что «Актив» наивысший орган управления. Он не прав! Это заявление было подано 19 сентября 2020 года, но Юрий Петрович отказывался его рассматривать и вообще не давал мне его в руки, поэтому только сейчас, 18 января 2021 года появилась возможность опубликовать его здесь.
И за всё это время я только и делаю, чтобы донести до всех, что наивысший орган Управления в нашем СНТ — это общее собрание членов СНТ. Почитайте странички этого сайта, просмотрите чат нашего СНТ и протоколы СНТ за 2020 год.
Далее Королёв И.А., Буянов Р., Керимов К.Г., Чернова Л.А., Коровкин Е.С., Журавель В.Н., Мкртычян А.С. в своём заявлении стали рассуждать как-то очень не здорово, такое ощущение, что они все чем то больны, стали писать про гомосексуалистов, активных и пассивных гомосексуалистов, про извращенцев и т.д. Здесь данную группу лиц я совсем не понял. О чём это они? Что у этих 7 человек в голове? Выводы сами собой напрашиваются…. У кого что болит, о том и говорит.
Далее меня обвиняют в том, что я пробрался в Правление СНТ не являясь членом СНТ. Отвечаю — я не избрался в Правление СНТ. Более того, мне предложили на собрании избираться в Председатели Правления СНТ, но я взял самоотвод. Всё это отражено в протоколе. В Правление СНТ была избрана моя жена, которая является членом СНТ. И тут же у меня возникает вопрос, почему Иван не кричит на каждом углу, что Саваровский В.В. незаконно избранный, что был избран в Правление СНТ не являясь членом СНТ?
Далее эта группа лиц с не очень здравым разумом на сексуальной почве пишет о том, что я ввёл всех в заблуждение по поводу доверенностей на Председателя. Отвечаю — я принёс на общее собрание членов СНТ Гражданский кодекс и показал соответствующую статью. Все с этим согласились. Статью не я придумал, она записана в гражданском кодексе. Какие могут быть ко мне претензии?
У меня же возникает вопрос. 13 сентября состоялось общее собрание. и уже 19 сентября команда этих лиц во главе Королёва Ивана, собственника участка 26 уже прибежала на заседание Правления с данным коллективным заявлением.
Чего они так испугались? Моих обещаний на общем собрании СНТ? Я обещал, что мы будем сотрудничать вместе с моей женой и главной нашей целью будет добиться того, чтобы в нашем СНТ было всё «прозрачно». Я делаю всё для этого!! На сайте нашего СНТ, который был создан по решению общего собрания СНТ, я размещаю только достоверную информацию — протоколы, законы и т.д. Но, есть люди, которым это очень не нравиться. Возникает вопрос — ПОЧЕМУ ? Почему им это не выгодно?
Может быть Королёв Иван очень не хотел, чтобы его незаконная предпринимательская деятельность по зимнему водопроводу вылезла наружу? Он же сам был в составе Правления СНТ 2018-2020 г. Выводы делайте сами….
